Order On order of the Court, the application for leave to appeal is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the order of the Court of Appeals, and REMAND the case to the Wayne County Circuit Court to consider whether the second-amended complaint states a cognizable claim, in avoidance of governmental immunity, by alleging that defendant Alan E. Beer, M.D., performed surgery beyond the scope of, or contrary to, plaintiff's consent and therefore beyond the scope of his authority. We do not retain jurisdiction.
